Settlement reached in class action lawsuit for 2015 Dunbar water main break
In 2015, residents of Dunbar, West Virginia, faced water service disruptions due to a water main break. Preston Webster, who had moved to Dunbar in 2013, expressed his disappointment at the unforeseen situation. The water interruptions began on June 23, 2015, when a leak in a water main in Dunbar occurred. Despite efforts to repair the leak, regular water service was only fully restored on June 27. Further problems emerged on June 29, prolonging the disruption until July 1.
The impact of the water main break extended beyond individual households, affecting businesses and the community as a whole. Webster lamented the adverse consequences, saying that it turned a once desirable town into a less appealing one. Efforts to address the issue resulted in a class action settlement being reached.
Danté DiTrapano, a lawyer involved in the case, explained that a class action lawsuit was filed on behalf of individuals who experienced similar water-related challenges due to the main break. Both residential and commercial properties were affected by the water issues in 2015. The settlement allows eligible individuals to file a claim and receive compensation for their losses.
According to DiTrapano, residential claims will receive a base payment of $175, with the possibility of additional compensation up to $500 by providing detailed expenses and information. Business claims are eligible for payments ranging from $500 to $1,500 based on submitted invoices and documentation. While Webster acknowledged his eligibility for the settlement, he expressed doubts about its adequacy in addressing the long-term impact of the water main break.
He likened the settlement to a temporary fix for a larger problem, emphasizing the importance of consistent and reliable water service. Despite the compensation offered, Webster stressed the necessity of prioritizing sustained infrastructure and service improvements to prevent similar disruptions in the future. If residents believe they qualify for the settlement, they are encouraged to access more information on filing a claim.
The resolution of the class action lawsuit marks a step towards addressing the challenges faced by Dunbar residents in 2015. It highlights the importance of accountability and restitution in response to infrastructure failures, emphasizing the significance of reliable water service for individuals and businesses alike.
