Criteria for new data breach class action: Qualifiers can receive $7,500 before July 11
Class action lawsuits are a powerful tool that allows multiple plaintiffs to join forces against corporations or individuals for shared grievances. Typically, these lawsuits arise when individuals need to unite against entities that are more powerful. They serve to hold these powerful entities accountable and bring about policy changes. Recently, a $1.1 million class action lawsuit settled a data breach case.
Data breaches and cyberattacks are becoming increasingly common in our digital age. Since 2001, financial losses due to cybercrimes have skyrocketed. Cyberattacks often result in the exposure of sensitive information like bank details and social security numbers, making individuals vulnerable to identity theft. Companies that handle such sensitive data have a duty to safeguard it. When they fail, consumers can band together in class action lawsuits to seek compensation for financial losses, identity theft, and breaches of privacy rights.
In 2023, WellNow Urgent Care faced a lawsuit after a data breach compromised patients’ sensitive information, including Social Security numbers. Although the clinic did not acknowledge any fault, they agreed to a $1.1 million settlement with the plaintiffs. The settlement includes two subclasses: those whose Social Security numbers were affected and those whose numbers were not compromised.
Individuals whose Social Security numbers were not breached are eligible for compensation for out-of-pocket expenses related to the data breach, up to $7,500. They can also claim up to two hours of lost time at a rate of $25 per hour. On the other hand, those whose Social Security numbers were compromised can also receive up to $7,500 for expenses and claim up to three hours of lost time. They may also choose a pro-rata share of the settlement instead of reimbursement for out-of-pocket losses.
To participate in the settlement, individuals must meet specific criteria and adhere to deadlines. It is crucial for affected parties to understand their eligibility and the requirements to receive compensation.
Class action lawsuits function as a mechanism to address injustices caused by corporations or entities that fail to protect sensitive data. By uniting in litigation, individuals can seek justice and hold accountable those responsible for data breaches. As technology continues to advance, the need for robust data protection measures becomes increasingly vital to safeguard individuals’ personal information from cyber threats.
